Con l'accordo di sicurezza sociale Italia–USA, i dipendenti distaccati dall'Italia possono restare assicurati INPS (ed esenti dalla Social Security USA) fino a 5 anni con il certificato di copertura.

Fiscalità dei distaccati

I distaccati possono diventare rapidamente residenti fiscali USA. Pianificate payroll nei due Paesi, shadow payroll e tax equalization con i consulenti.

Famiglie

Coniuge e figli hanno bisogno di visti derivati. I coniugi E-2 e L-2 possono in genere lavorare; i coniugi H-4 solo in casi limitati.

  1. Verificate i requisiti: E-2 (proprietà italiana, ruolo chiave) o L-1 (1 anno nel gruppo all'estero).
  2. Preparate i documenti societari: assetto proprietario, bilanci, business plan USA, organigramma.
  3. Incaricate un avvocato immigrazione USA e concordate le tempistiche con il dipendente.
  4. Richiedete all'INPS il certificato di copertura in caso di distacco.
  5. Pianificate il trasferimento: casa, scuole, patente, iscrizione ai benefit USA.
  6. Completate il Form I-9 all'arrivo e inserite il dipendente nel payroll USA.

Social security

Under the U.S.–Italy social security agreement, employees seconded from Italy can remain covered by INPS (and exempt from U.S. Social Security) for up to 5 years with a certificate of coverage.

Tax for seconded staff

Seconded employees may become U.S. tax residents quickly. Plan payroll in both countries, shadow payroll and tax equalization with advisers.

Families

Spouses and children need dependent visas. E-2 and L-2 spouses can generally work; H-4 spouses only in limited cases.

  2. Prepare corporate documents: ownership, financials, U.S. business plan, organizational chart.
  3. Engage a U.S. immigration attorney and agree the timeline with the employee.
  4. Request the INPS certificate of coverage for social security if seconding.
  5. Plan relocation: housing, schools, driver's license, U.S. benefits enrollment.
